Terms of Service
By using Thirdwatch you agree to these terms. If you do not agree, do not use the service.

1. The service
“Thirdwatch” (“we”, “us”) provides (a) the website at thirdwatch.dev, (b) the Thirdwatch MCP server, and (c) a family of public scraper actors hosted on the Apify platform (collectively, the “Service”). Use of any actor on the Apify platform is also subject to Apify's own terms.
2. Accounts
You must provide accurate sign-up information and keep credentials secure. You are responsible for activity under your account. Notify us at support@thirdwatch.dev immediately if you suspect unauthorized access. Accounts are personal to a legal entity or individual; do not share credentials.
3. Acceptable use
You agree not to use the Service to:
- scrape any website in violation of that website's applicable laws, terms, or robots directives where those are legally binding on you;
- harvest or process personal data in violation of any applicable data protection law (GDPR, DPDP, CCPA, or others);
- target endpoints requiring authentication, paywalled content, or content behind technical access controls you are not authorized to bypass;
- attempt to gain unauthorized access to the Service, probe for vulnerabilities, or interfere with other users' runs;
- resell raw access to the Service to third parties as a substitute scraping API without a separate written agreement;
- use outputs to train models or build datasets that compete directly with Thirdwatch without our prior written consent.
You are solely responsible for what you scrape, how you store it, and what you do with it. Compliance with the laws of your jurisdiction and the laws governing the targets is your responsibility.
4. Pricing & payment
Pricing for actors and MCP tools is published at the actor's Apify Store listing or at /pricing. Most actors are billed pay-per-result via Apify; the MCP server is billed via Dodo Payments. Fees are non-refundable except where required by law or where we explicitly agree in writing.
We may change prices with 30 days' notice. Continued use after a price change constitutes acceptance.
5. Service availability
We aim for high availability but do not guarantee uninterrupted service. Public scrapers depend on third-party websites whose structure or anti-bot defenses may change at any time, which can temporarily reduce success rates. We reserve the right to deprecate actors or features with reasonable notice.
6. Intellectual property
The Thirdwatch name, logo, codebase, and infrastructure are owned by us. We grant you a limited, non-exclusive, non-transferable right to use the Service. Nothing here grants you any right in our marks or source code.
Outputs returned by the Service consist of factual data scraped from public sources. We make no claim to copyright in those outputs but also make no warranty about your right to redistribute them; that is your responsibility to assess.
7. Disclaimer of warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY OF SCRAPED DATA. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE OR THAT ANY PARTICULAR SCRAPING TARGET WILL REMAIN ACCESSIBLE.
8. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY UNDER OR IN CONNECTION WITH THESE TERMS IS LIMITED TO THE FEES YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR LOST DATA, EVEN IF ADVISED OF THE POSSIBILITY.
9. Indemnification
You agree to indemnify and hold us harmless from claims arising out of your use of the Service in violation of these terms or applicable law, including claims by third-party websites whose terms you breached while using our scrapers.
10. Termination
You may stop using the Service at any time. We may suspend or terminate your access for material breach of these terms (including the acceptable-use rules in section 3), for non-payment, or where required by law. On termination, your right to use the Service ends immediately; sections 6, 7, 8, 9, and 11 survive.
11. Governing law & disputes
These terms are governed by the laws of India, without regard to conflict-of-laws rules. Any dispute arising under these terms will be subject to the exclusive jurisdiction of the courts of Bangalore, Karnataka, India. Nothing in this section limits any non-waivable consumer rights you may have under your local law.
12. Changes to these terms
We may update these terms as the Service evolves. Material changes will be announced on the site and, where required, by email. Continued use of the Service after a material change constitutes acceptance.
